Canadian Immigration for spouse..?

Postby mohd_umaraz on Sat Apr 19, 2008 8:31 am

I am a Canadian national but I live in the US on a green card. I have about 2 years before I could become a US national. My wife lives outside of North America. If I sponsor her to US under my green card it will take her forever to come here. Can I sponsor her to Canada and then she can wait in Canada till I become a US national and then I can sponsor her to US. Her coming to Canada will make it easier for me to see her and spend some time with her. I live and work in the US. I pay my taxes here in the US. Is there any way possible to get her to Canada? Thank You

your best answer could be to talk to an imagration lawyer if they can't give you an answer no one can.

In short, no. You can't just sponsor someone to come to a country nearest you. A US green card just allows you to work there, it does not allow you to sponsor anyone else. By 'national' I assume you mean a Canadian citizen. You cannot sponsor someone to come to Canada unless you are a permanent resident here. Sorry.

To the best of my knowledge you must be living in Canada in order to sponsor her into Canada. There may be a way to do this but I have never came across it. An immigration lawyer in Canada could give you the best information.Canada would be hesitant to let you use their immigration system for your wife when you don't even live there and are seeking PR status in another country and would eventually move your wife to the US.

As a Canadian citizen, you can sponsor your spouse to come to Canada as a PR without being in Canada yourself but you have to convince immigration that you both are planning to live in Canada when she gets her PR. You could do this via job offer, acceptance to university, ownership of a house or condo etc but it might not be easy.

If you sponsor her to Canada you MUST be living and working in Canada to do that. And you cannot do that on the green card. So you either stay in USA and sponsor (petition) her to USA and then after she is a citizen of USA then you can sponsor her to Canada. Or you give up the green card and move back to Canada and sponsor her to this great country.
