Canadian re-entering US after B2 expires?

Postby emilie on Sun Mar 02, 2008 6:51 pm

my boyfriend is Canadian, and his B2 visa will expire on Oct 1st we have gone to the immigration office and they said its to late to extend his stay that he should just cross the border and come back.how long does he need to stay in Canada to re enter ?will it work if he has a return ticket going back to Canada and proof that he has enough money? i don't know why the Immigration officer gave him a visa..he just said he had till Oct 1st to get of the country, he was kinda mean to us when we were crossing the border and he even stamped my passport and i am a permanent resident of the US , and when i enter the US i never had my passport stamped till that dayhe has money saved up from working in Canada, he is staying at my house so he doesn't need to pay for food or housing

Yes - going back to Canada, even for a day or two, is enough to prove to the authorities he has left the country. Make a nice holiday out of it and go for a week if you have the money and time off. The trees are gorgeous this time of year.

I think the question that needs to be answered first is why was your boyfriend required to obtain a visa. Were there circumstances that made him inadmissible to enter the U.S. uncontrolled. How long has he been in the United State for? How is he supporting himself while he is here? Some one telling him it is OK to just go back across the border and then just return could be giving him very bad advice. We have something called continuous presences and depending on how long he has been here and how many times before it could get him jammed up.
